ENGAGEMENT ♦

Client provides clear and complete requirements, reference, or assets before Work begins.You are only purchasing the Digital Illustration File. Not the printed art. Once Work has begun or payments have been made, the Client acknowledges Work and deliverables are digital and there are no physically shipped goods to receive.Communication through email, or Twitter private messages. Only WRITTEN information will be taken into consideration.For any commission type to be accepted and finalized in completion, In sign of good faith. The Client, Businesses, agencies, groups and other organizations must follow my twitter illustration profile. [twitter.com/EnigmaArc_]Artist's response time may vary, up to 3 days in order to provide better or more concrete updates.

WIP / Process Images

Will only be given if the client requests for it and if the price of the commission:
[1 Illustration type] exceeds 250$ (not total price).
[Bulk of illustrations] exceeds $500 (not total price).Some of my pieces don't include WIP's (work in progress images), to avoid taking too long on orders that only take me a few hours.

PAYMENTS ♦

Client pays full payment upfront to place an order.Down payments may be requested for orders over 500$, with a required down payment of 50% to place the order and 50% after SKETCH is approved.Invoices, proposal or payment link will be sent to the Client when Artist is ready to begin work.Prices are in USD, and paid via PayPal or methods as provided by the Artist.Prices may vary depending on complexity, requirements and/or additional requests.Client warrants they will not issue chargebacks and the refund policy mentioned below will be followed.

ACCEPTANCE ♦

Client is 18+ and legally able to commit to an agreement or has a legal guardian to make this agreement on their behalf.Agreement date is upon first inquiry/communication or first transaction.If art is to be used on merchandise (ie Posters/Prints, Keychain, Clothes, etc) then an extra fee is applied. It will be discussed prior to acceptance of commission.After the art is completed and Client intends to use it on merchandise (ie Posters/Prints, Keychain, Clothes, etc) It will and must be discussed with the Artist ( There WILL be a compensation fee if right has been abused.)If you require your work earlier then
first discussed, pay a RUSH FEEIf you require your work to be done (within reason in Artist's decision.) incredibly quicker then my standard process, pay a RUSH FEENote: Businesses, agencies, groups and other organizations should contact the Artist to discuss arrangements in more detail.

DELIVERY TIME ♦

DELIVERY TIMENon-Commercial commissions:
I do NOT give deadlines, because I never know when a Client will pay a rush fee and increase the wait time.Commercial commissions:
Deadlines must be discussed prior agreement to be accepted.Rush fees for Commercial intended commissions WILL be paid first before any process speed change.
If request for a Rush fee is unreasonable; in terms of pricing and/or time needed done. The Client are untitled to cancelation of payment.

CANCELING & REFUNDING POLICYYou have no right to cancel or demand a refund unless the commission is not completed in 5 months even if I haven't started it.

RIGHTS OF PARTIES ♦

The Artist reserves the right to refuse completion of the work should the client make unreasonable and/or demeaning demands.The Artist does not authorize the non-commercial commission/s art/designs to be used for Advertisements, NFT or any form of cryptocurrency and AI art.Do not claim illustration credits for the non-commercial commissioned work. The Artist retain full rights over any project that is created, and may display it in their portfolio & social media.The claim credits for the commercial illustration commissioned work may vary through written communication. The Artist always retains rights over any project that is created, to display it in their portfolio & social media.The Client may repost/share commissioned work on social media under the condition that they give proper credits and link back to one of the socials of the Artist.The Client does not have the right to alter the received artwork without first discussing it with The Artist. ( There WILL be a compensation fee if right has been abused.)In the case The Client wishes to resell the Live2D model

please notify the Artist first.The Client reserves the right to make requests for reports from the Artist. Provided: reports shall only be made within reasonable hours and may not be done immediately upon request.The Client reserves the right to discontinue this contract. Provided: the down payment shall be forfeited in favor the Artist, Provided further: exercise of this right must be done before completion by the Artist of the task.
